Delivery Terms & Conditions
These Delivery Terms and Conditions (“Terms”) apply where Harlen Design PTY LTD (ABN: 38 680 457 916) supplies bathroom vanities to a Customer (“you”) within Australia. By placing an order, the customer (“you”) agrees to these Terms.
1. Delivery Method
- All deliveries are made via tail lift truck and pallet jack.
- Delivery is to kerbside or nearest flat, accessible area only. We do not deliver inside homes, upstairs, or beyond the first point of access.
- A photograph of the item as received inside its packaging will be taken to document its condition, including the absence of any visible damage to the outer packaging.
2. Delivery Access Requirements
- You must ensure clear and safe access for a tail lift truck (up to 10 tonnes) and pallet jack.
- Delivery sites must have:
- A level, hard surface (e.g., concrete or bitumen – no gravel or grass).
- Sufficient space for the truck to park and safely operate the tail lift.
- If access is deemed unsafe or unsuitable, delivery may be aborted at your cost (see Clause 5).
3. Delivery Timeframes & Delays
- We will do everything to ensure that your vanity is delivered within specified timeframes, however these are estimates only and cannot be guaranteed due to delays out of our control, including but not limited to:
- Shipping delays from point of origin
- Custom clearance delays
- Port congestion or operational delays
- Road transport delivery congestion
- Extreme weather events – flooding, cyclones, extreme temperatures
- Public holidays
- Third-party freight carrier delays
- We are not liable for any loss, expense, or damages resulting from delivery delays.
- Customers will be notified via email to contact details provided at the time of order, of any potential delays in delivery and will be provided with updated delivery timeframes as soon as they become available.
- The Customer acknowledges and agrees that unforeseen circumstances—including but not limited to traffic congestion, adverse weather conditions, delivery delays, and road closures—may affect Harlen’s ability to complete delivery by the scheduled delivery date. In such events, customers will be notified via phone and email and delivery may be rescheduled without liability.
4. Missed Deliveries / Redelivery
A text message will be sent the day prior to delivery reconfirming the delivery window. It is your responsibility to ensure someone is available to accept and sign for the goods during the advised delivery window.
- If no one is available to accept the delivery at the arranged time:
- The delivery will be deemed missed.
- Redelivery fee of $195 to metro areas will apply. For deliveries outside of metro areas the original delivery fee as per the initial quote will be charged again.
5. Failed Delivery & Storage Fees
- We reserve the right to cancel delivery to certain areas where access has been deemed unsafe or not feasible. In this situation the delivery will be deemed a failed delivery and redelivery fee’s (see clause 4) will apply. An alternative delivery address must be supplied within 24 hours of a failed delivery to avoid possible further storage charges.
- Storage begins on the first business day after 2 missed or failed delivery attempts.
- Storage fees are $50 per week
6. Inspection on Delivery
- You must inspect the vanity on the day of delivery, and any warranty claims must be reported to us in writing as per the warranty terms and conditions and timeframes.
- Claims made after the timeframes specified in the warranty terms and conditions may not be accepted.
7. No Unpacking or Installation
- Our delivery service does not include unpacking, positioning, or installation of any product.
- Delivery staff are not permitted to enter buildings or assist beyond the drop-off point.
8. Remote or Regional Deliveries
- Additional delivery lead times and/or charges may apply for regional or remote areas.
9. Risk and Title
- Risk in the goods passes to you upon delivery.
Title passes only once full payment has been received.
